Expanded Whistleblower Law and Notice Requirement in New York

The New York State Department of Labor released a new form notice that all New York employers must post regarding the recently expanded Whistleblower Law. 

The notice requirement is the result of amendments to the Whistleblower Law, effective January 26, 2022. Among other changes, the Whistleblower Law now prohibits retaliation against current and former employees, as well as individuals hired as independent contractors, who report or threaten to report violations of law, rule or regulation.  Previously, the Whistleblower Law prohibited retaliation against employees who reported or threatened to report violations of law, but only if such violations posed certain health and safety risks.
